Traditional versus Nontraditional Litigation
Litigation is the service of opening, maintaining and defending a lawsuit(Cheeseman, 2010). The process of litigation is difficult, costly, and a time consuming process with stringent rules that are enforced. The tribunal system decides on matters of disputes between parties in litigation. Trial attorneys that demo the clients are referred to as Litigators. The actions of harm to the defendant are claimed by the plaintiff. The nontraditional alternative to litigation is an alternative dispute firmness (ADR). The ADR is used in negotiation, mediation and arbitration.
Litigation
Lawsuits are defined by the conflicts or controversy that are legally authorized and resolved by a romance. When one individual or establishment sues another for damages it goes forward to litigation. A reason wherefore the individual enters a lawsuit is to remedy the injustice or enforce a right. The trial respondent, the petitioners, applicant, defendants, and the plaintiffs are all referred to as litigators. An attorney with experience has the knowledge of the laws, rules, and the policies that govern the process of litigation.
The process of litigation is done in phases: pleading, answering, discovery, fronts, and the trial. During the pleading phase the defendant is served with the complaint or petition. The answers and request of information regarding the case is filed by the defendant. During the phase of discovery, both ramps question one another. Either side may ask for dismissal or mediation during the motion portion. The process is completed in the litigation process when the unlikeness is resolved by jury or judge.
